PLEASE READ THESE USER TERMS CAREFULLY BEFORE DOWNLOADING OUR APPLICATION AND/OR USING OUR WEBSITE.

1.General Terms and Conditions:

The Isupportcar provides technology based services for booking taxis on PAN-India basis to you and you agree to obtain taxi services offered by third party taxi providers, drivers or vehicle operators ("the Service Provider"). All the Services provided by the Company to you by means of your use of the booking platform are hereinafter referred to as the "Service."
The Isupportcar shall take your booking request and forward it to the Service Provider through GPS-GPRS based device installed in the Taxi. The Service Provider shall have the sole discretion to accept or reject each request for taxi service. The Service Provider has discretion over whether to receive the booking request made by the Company. If the Service Provider accepts the booking request made by the Company, the GPS device installed in the Taxi notifies you and provides the information regarding the Service Provider including its name, contact number etc.
The Isupportcar shall made reasonable efforts to bring you in contact with the Service Provider in order to obtain taxi Service subject to availability of the Service Provider in or around your location at the time of your booking request made to the Company.
For the avoidance of doubt, it is clarified that the Company itself does not provide taxi services. It is the Service Provider who shall render taxi service to you. The provision of the taxi services by the Service Provider to you is therefore subject to the agreement (to be) entered into between you and the Service Provider and the Company shall never be a party to such agreement. Even after acceptance of booking, the Service Provider may not reach your pick up location or decide not to render his services in which event the Company shall not be held liable to you.
You warrant that the information you provide to the Isupportcar is accurate and complete. The Isupportcar is entitled to at all time verify the information that you have provided. You may only access the Service using the authorized means. It is your responsibility to check to ensure you download the correct mobile application for your device or visit the correct portal or dial-in the accurate call center number. The Isupportcar shall not be liable if you do not download the correct mobile application or visit the appropriate web portal or dial-in the correct call center number. The Isupportcar reserves the right to discontinue or introduce any of the modes of booking Taxi.
You will refrain from doing anything which we reasonably believe to be disreputable or capable of damaging our reputation;
You will comply with all applicable laws;
h.You will treat taxi drivers introduced to you through us with respect and not to cause damage to their taxi or engage in any unlawful, threatening, harassing, abusive behaviour or activity whilst using their taxi or the service;
You will compensate and defend us fully against any claims or legal proceedings brought against us by any other person as a result of your breach of these Terms.
Please note that we are not responsible for the behaviour, actions or inactions of drivers of taxis, quality of cab which you may use (through us or otherwise). Any Contract for the provision of taxi services is between you and the driver and not us and we simply provide a platform to introduce drivers and passengers.
By using the mobile Application of the Company, you further agree that:
1. You will download the Application for your sole, personal use and will not resell it to a third party;
2. You will not authorize others to use your account;
3. You will not assign or otherwise transfer your account to any other person or legal entity;
4. You will not use an account that is subject to any rights of a person other than you without appropriate authorization;
5. You will not use the Application for unlawful purposes, including but not limited to sending or storing any unlawful material or for fraudulent purposes;
6. You will not use the Application to cause nuisance, annoyance or inconvenience;
7. You will not impair the proper operation of the network;
8. You will not try to harm Application in any way whatsoever;
9. You will not copy, or distribute the Application or other Company Content without written permission from Company;
10. You will keep secure and confidential your account password or any identification we provide you which allows access to the Application;
11. You will provide us with whatever proof of identity we may reasonably request;
12. You will only use an access point or 3G data account (AP) which you are authorized to use;
13. You will not use the Application with an incompatible or unauthorized device;
14. You will comply with all applicable law from your home nation, the country, state and/or city in which you are present while using the Application.

2.Charges and Payment:

You will make payment in full to any taxi drivers introduced to you through us for any services provided by such driver to you (although you may choose to use the app to facilitate such payment). You shall be required to pay trip charges for taxi service to the Service Provider and the rates of can be found on the Website and Mobile Application of the Isupportcar . The Trip charges shall be updated or amended from time to time and it shall be your responsibility to remain informed about the current trip charges for the taxi services. You agree that you will pay for all taxi services you purchase from the Service Provider either by way of cash or credit card. In the event the payment cannot be accepted through credit card / mobile application, you shall be required to pay the trip charges by way of Cash. Any payment made is non-refundable. At the end of the trip, we will facilitate for you to receive a copy of the invoice from the Service Provider on your registered e-mail account with the Company.

3.Indemnification:

By accepting these User Terms and using the Application, you agree that you shall defend, indemnify and hold the Company, its affiliates, its licensors, and each of their officers, directors, other users, employees, attorneys and agents harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys' fees and costs) arising out of or in connection with: (a) your violation or breach of any term of these User Terms or any applicable law or regulation, whether or not referenced herein; (b) your violation of any rights of any third party, including Service Providers arranged via the Application, or (c) your use or misuse of the Application or Website.

4.Liability:

The information, recommendations provided to you on or through the Website, or the Application is for general information purposes only and does not constitute advice. The Isupportcar will reasonably keep the Website and the Application and its contents correct and up to date but does not guarantee that (the contents of) the Website and/or Application are free of errors, defects, malware and viruses or that the Website and/or Application are correct, up to date and accurate.
The Isupportcar shall not be liable for any damages resulting from the use of or inability to use the Website or Application (but to the exclusion of death or personal injury), including damages caused by malware, viruses or any incorrectness or incompleteness of the Information or the Website or Application, unless such damage is the result of any wilful misconduct or from gross negligence on the part of the Isupportcar .
The Isupportcar shall further not be liable for damages resulting from the use of (or the inability to use) electronic means of communication with the Website or the Application, including – but not limited to – damages resulting from failure or delay in delivery of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs used for electronic communications and transmission of viruses.
Without prejudice to the foregoing, and insofar as allowed under mandatory applicable law, the Company's aggregate liability shall in no event exceed an amount of INR 1000.
The quality of the taxi services requested through the use of the Application or the Service is entirely the responsibility of the Service Provider who ultimately provides such taxi services to you. The Isupportcar under no circumstance accepts liability in connection with and/or arising from the taxi services provided by the Service Provider or any acts, action, behaviour, conduct, and/or negligence on the part of the Service Provider. Any complaints about the taxi services provided by the Service Provider should therefore be submitted to the Service Provider.

5.INTELLECTUAL PROPERTY RIGHTS (Trademarks and Copyrights):

The Isupportcar is the sole owner and lawful licensee of all the rights to the web site, mobile application or any other digital media and its contents. The content means its design, layout, text, images, graphics, sounds, video, etc. the website, mobile application or any other digital media content embody trade secrets and intellectual property rights protected under worldwide copyright and other laws. All titles, ownership and intellectual property rights in the website and its content shall remain with the Isupportcar , its affiliates, agents, authorized representatives or licensor's as the case may be.
All rights not otherwise claimed under this Terms and Conditions or by the Company are hereby reserved. The information contained in this web site is intended, solely to provide general information for the personal use of the reader, who accepts full responsibility for its use.
The Isupportcar does not represent or endorse the accuracy or reliability of any information or advertisement contained on, distributed through, or linked, downloaded or accessed from any of the services contained on this website, or the quality of any products, information or other materials displayed, or obtained by you as a result of any product, information or other materials displayed, or obtained by you as a result of an advertisement or any other information or offer in or in connection with the service.

Subject to your compliance with these Terms, the Company grants you a limited non-exclusive, non-transferable license to download and install a copy of the Application on a single mobile device that you own or control and to run such copy of the Application solely for your own personal use.

7.Term and termination of the contract:

The Contract between the Company and you is concluded for an indefinite period. You are entitled to terminate the Contract at all times by permanent deletion of the Application installed on your smart phone, thus disabling the use by you of the Application and the Service.

Isupportcar is entitled to terminate the Contract at all times and with immediate effect (by disabling your use of the Application and the Service) if you: (a) violate or breach any term of these User Terms, or (b) in the opinion of the Isupportcar , misuse the Application or the Service. The Isupportcar is not obliged to give notice of the termination of the Contract in advance. After termination the Isupportcar will give notice thereof in accordance with these User Terms.

8.Invalidity of one or more provisions:

The invalidity of any term of these User Terms shall not affect the validity of the other provisions of these User Terms.

If and to the extent that any provision of these User Terms is invalid, or is unacceptable in the given circumstances according to the criteria of reasonableness and fairness, a provision shall apply between the parties instead that is acceptable considering all the circumstances and which corresponds with the provisions of the void part as much as possible, taking into account the content and the purpose of these User Terms.

9.Modification of the Service and User Terms:

The Isupportcar reserves the right, at its sole discretion, to modify or replace any of these User Terms, or change, suspend, or discontinue the Application (including without limitation, the availability of any feature, database, or content) at any time by posting a notice on the Website or by sending you notice through the Service, Application or via email. The Company may also impose limits on certain features and services or restrict your access to parts or all of the Service without notice or liability.

10.Notice:

The Isupportcar may give notice by means of a general notice on the Service or Application, or by electronic mail to your email address on record in the Company's account information, or by written communication sent by regular mail to your address on record in Company's account information.

11.Assignment:

You may not assign your rights under these User Terms without prior written approval of the Company..

12.Privacy and Cookie Notice:

The Company collects and processes the personal data of the visitors of the Website and users of the Application according to the Privacy and Cookie Notice

13.Excusable Delays (Force Majeure):

Neither party hereto shall be responsible for delays or failures in performance resulting from acts beyond its reasonable control and without its fault or negligence. Such excusable delays or failures may be caused by, among other things, strikes, lock-out, riots, rebellions, accidental explosions, floods, storms, acts of God and similar occurrences.

14.Miscellaneous:

The Courts of Alwar, India shall have the sole and exclusive jurisdiction in respect of any matters arising from the use of the services offered by the Isupportcar or the agreement or arrangement between the Isupportcar and the Customer. All claims and disputes arising under this Terms and Conditions should be notified to the Company within 30 days from the event date after which no You shall have any claim against the Company.
The Isupportcar shall be entitled to add to, vary or amend any or all these terms and conditions at any time and the Customer shall be bound by such addition, variation or amendment once such addition, variation or amendment are incorporated into these terms and conditions at website at www.isupportcar.webs.com or on the date that the Company may indicate that such addition, variation or amendment is to come into effect.
c.The Isupportcar reserves the right to publish information of beneficiaries of any program, offer, scheme or any promotion.
The Customer who seeks to use or obtain any of the services, benefits, facilities and arrangements as offered by the Company's Partner, then the provisions of such services, benefits, facilities or arrangements will be subject to the respective terms and conditions of the said Service Provider, being the provider of the said services, benefits, facilities or arrangements.
The Isupportcar provides links to third party website as a convenience to the Customers or as an advertisement and the Company does not have any control over such sites i.e. content and resources provided by them. The Company recommends reading such site's terms and conditions and/or privacy policies before using such sites.
This web site (www.isupportcar.webs.com) is published and maintained by Sarvjan Kalyan Charitable Trust, browsing or use of the facilities provided by this site constitutes a deemed acceptance, without limitation or qualification, of the terms and conditions as set forth herein below, by the user and constitutes an agreement between Company and the Customers.

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
These terms and conditions (Service-User terms) apply on the usage of our website www.isupportcar.webs.com (the "Website"), smart phone Isupportcar Application (the Application) as well as to all information, recommendations and/or services provided to you on or through the Website, the Application or through the Customer Care through a Mobile phone number 9461001428. The term 'YOU' refers to the user of our services through Website, the Application and the Customer Care .
The terms and conditions mentioned in this contract along with the Privacy Policy constitute the entire contract between the User(s) and Isupportcar Cab Service with respect to access to and use of the website / application and the Services offered by Isupportcar Cab Service , superseding any prior written or oral contracts in relation to the same subject matter herein.
THE SERVICE
Isupportcar Cab Service offers a technology platform on www.isupportcar.webs.com and Mobile Application Isupportcar Cab available on iOS, Windows & Andriod platforms.
Isupportcar Cab Technology platform is an enabling platform for a consumer to connect with a third party, independent valid permit holder drivers or vehicle operators known as The Taxi Service Provider hereinafter referred as TSP. Once TSP accepts a request, customer is notified with the details of TSP through sms,email or Mobile application.
Isupportcar Cab shall do all the reasonable efforts to connect you with a TSP & the services are subject to the availability of TSPs in or around your location at the moment of your request for Taxi services.
By using this website and/or Mobile Application or user of the service through The Customer Care you hereby acknowledges that Isupportcar Cab is not a Taxi/Vehicle services provider.
It is up to the TSP to offer Taxi services, which may be requested through the use of the Website, Application or Customer Care. Isupportcar Cab only acts an intermediary between you and the TSP.
The user has to note that TSP is your service provider and therefore it is subjected to the contract between YOU and the TSP. Isupportcar Cab shall never be a party to such contract.
Isupportcar Payment Procedure:
You may choose to pay for the Services by either of the following two methods:
1. Cash payment: Cash payment shall be made at the time of boarding the cab.Where You opt to pay by cash, You shall make the cash payment at the time of boarding, such amount shall be the amount specified to You at the time of booking confirmation. You will be required to pay the amount shared with You at the time of booking confirmation even if You opt to take a drop in between Your ride.
2. Online Payment:- We will generate an invoice on behalf of the driver servicing Your offer request, which will be sent across to Your Original ID after the completion of the Ride. The Invoice shall be indicative of all applicable charges inlcuding but not limited to the surcharge, toll charges, right time charge, wait time charge, service tax. Any payment made is non-refundable.
3. Waiting policy:-
4. The Isupportcar cab shall wait only for 2 (Two) minutes for the Customer at the pick location. If the customer does not board within 2 (Two) minutes, then the Isupportcar cab may cancel the trip and leave the pick-up location.
5. Cancellation policy
6. You may cancel the booking as early possible prior to the boarding of the Vehicle and commencement of the Ride, without any cancellation charges. Isupportcar cab may cancel the booking anytime prior to the payment of fare by the Customers to the Isupportcar cab either through cash or through PAYUMONEY. In the event of a deduction of fare from the Customers PAYUMONEY post a valid cancellation by Isupportcar cab , the amount so deducted shall be refunded to the Customer within 72 hours. Isupportcar cab does not warrant that a re-allotment of a Vehicle for the purposes of the Service under these T&Cs and a re-confirmation of booking shall be made once a cancellation has been effected by either Parties.
7. Luggage policy
  While using the Service You may not carry heavy luggage like suitcase, big bags etc. with You. However, You can carry handbags, backpacks etc. which You can easily carry along without taking much space or without using Your co-passenger seat space.
8. REPRESENTATION, WARRANTIES, INDEMNIFICATION AND LIMITATION OF LIABILITY
  Without prejudice to the above, the Company makes no representation or warranty that:
  - The Services will meet the customer's requirements.
  - The Services will be uninterrupted, timely or error-free.
  - Isupportcar cab shall not be responsible or liable for any loss or damage, howsoever caused or suffered by the Customer arising out of the use of Cab service offered by TSP or due to the failure of TSP to provide Services to the Customer for any reason whatsoever including but not limited to the Customer's non-compliance with the Services' recorded voice instructions, malfunction, partial or total failure of any network terminal, data processing system, computer tele-transmission or telecommunications system or other circumstances whether or not beyond the control of Company or any person or any organization involved in the above mentioned systems.
  - Isupportcar cab will not be liable for any damages of any kind arising from the use of the Service offered by the TSP including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
  - Isupportcar cab will take all reasonable measures to ensure that TSP should fulfill his duty properly but there may be exceptions and if any passenger misses the train or flight or bus, Isupportcar cab will not be hold liable for any such compensation. The customer is advised to make alternate arrangement in case the cab has not reached due to any reason.
  - The Isupportcar cab shall not be liable for any conduct of the drivers of the Cabs. Isupportcar cab encourages you to notify any complaints that you may have against the driver of any Cab that you may have hired using the Isupportcar cab platform.
  - All the vehicles registered with Isupportcar cab platform are continuously tracked using GPS for security reasons only. It is expressly made clear to you hereby that the Isupportcar cab does not own any Cabs nor does it directly or indirectly employ any drivers for the Cabs. Isupportcar cab disclaims any and all liability in respect of the drivers and the Cabs alike.
  - CONSENT TO ELECTRONIC COMMUNICATIONS AND TRANSACTIONS
    By clicking the ‘I Agree’ button, you consent to conduct transactions and receive communications, notices and information from us electronically, whether sent by e-mail or other electronic means. Electronic communications shall be deemed to have been received by you when we send the electronic communication to the email address / mobile number that as per our records, or when we post the electronic communication on the Application or the Website.
    CHOICE OF LAW AND DISPUTE RESOLUTION
    These Terms shall be governed by, and construed in accordance with, the laws of India, without reference to principles of conflicts of law. The parties agree that the courts of Alwar shall have exclusive jurisdiction over any dispute arising from or relating to these Terms, the Application or the Website. You expressly consent to the personal jurisdiction of said courts and waive any objection to such personal jurisdiction based on forums non convenience or any other basis.
    1. Termination and expiry of the account
      We reserve the right to modify, terminate or suspend Services to You at any time without prior notice due to any changes in internal policy or the Applicable Laws or any breach of these T&Cs by You or for any reason whatsoever. You can exit Your Community/Registered Community/Deemed Community/Open Community using the Application/website and/or terminate Your Account by submitting a request to Us at [email protected] We will make every effort to respond to Your request for termination at the earliest. You will remain responsible for all Transactions that occurred prior to termination of Your Account.
    2. Disclaimers
      1. Except for Our limited role in providing You cab booking facility that You authorize or initiate, We are not involved in any underlying transaction between You, any other Customer, CSPs or other third party. We are not a selling agent in relation to any sale of goods or services to You by any CSP or any other third party. We shall not be liable for the quality, safety, reliability, legality, delivery or any other aspect of any service that You may avail using the Application/website. Your use of the Service is at Your sole risk. The Service is provided on an "as is" and "as available" basis. We do not guarantee and do not promise any specific results from use of the Application/website and/or the Services, including the ability to avail the Services at any particular location or time. We disclaim all warranties of any kind whether express or implied including without limitation, any representation or warranty for accuracy, availability, continuity, uninterrupted access, timeliness, sequence, quality, performance, security, merchantability, fitness for any particular purpose, non-infringement or completeness. Without prejudice to the forgoing paragraph, We do not warrant that:
        This Application/website will be constantly available, or available at all; or
        The information on this Application/website is complete, true, accurate or non-misleading; or
        This Application/website; information, Content, materials, product (including software) or services included on or otherwise made available to You through the Application/website; their servers; or electronic communication sent from Us are free of viruses or other harmful components; or
        Content on the Application/website constitutes, or is meant to constitute, advice of any kind;
      2. Your correspondence or business dealings with, or participation in promotions of, third party advertisers found on or through the Application, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between You and such third party advertiser. We shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such third party advertisers on the Application.
      3. Isupportcar shall not be responsible or liable for any loss or damage, howsoever caused or suffered by the Customer arising out of the use of cab service offered by CSP or due to the failure of CSP to provide Services to the Customer for any reason whatsoever including but not limited to the Customer's non-compliance with the Services' recorded voice instructions, malfunction, partial or total failure of any network terminal, data processing system, computer tele-transmission or telecommunications system or other circumstances whether or not beyond the control of Isupportcar or any person or any organization involved in the above mentioned systems.
      4. You acknowledge that while Isupportcar employs certain quality control measures, Isupportcar does not, and cannot exercise control over the quality or safety of the transportation that is made use of by You through the Services.
      5. Isupportcar will not be liable for any damages of any kind arising from the use of the service offered by the CSP including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
      6. Isupportcar will take all reasonable measures to ensure that CSP should fulfill his duty properly but there may be exceptions and if any passenger misses the train or flight or bus, Isupportcar will not be held liable for any such compensation. The Customer is advised to make alternate arrangement in case the cab has not reached due to any reason.
      7. The ride services, and any claim resulting from the same, while requested through the Application, remains the responsibility of the CSPs and Isupportcar shall not be liable for any conduct of the CSPs. Isupportcar encourages You to notify any complaints that You may have against the driver of any Cab that You may have hired using the Isupportcar ’s platform
      8. Isupportcar is not responsible for the conduct, whether online or offline, of any other user of the Application or Services. You are solely responsible for Your interactions with other users, whether drivers or Co-Passengers. By using the Application/website and the Services, You agree to accept such risks and acknowledge that Isupportcar is not responsible for the acts or omissions of other users.
      9. The Customer acknowledges that in the event the Customer does not avail the Service(s) in the Vehicle allocated to him/her by Isupportcar and/or the Customer exchanges the seat allocated to him/her with a seat allocated to another Customer in another Vehicle, the Customer shall do so at its own and sole risk. Isupportcar shall not bear any liability arising out of or in connection with such acts on the part of the Customers.
      10. All the vehicles registered with Isupportcar platform are continuously tracked using GPS for security reasons only. It is expressly made clear to You hereby that Isupportcar does not own any cabs nor does it directly or indirectly employ any of the CSPs for the cabs. Isupportcar disclaims any and all liability in respect of the CSPs and the cabs alike.
      11. The location data made available on the Application/website is basic is nature, and meant to provide guidance to drivers only. You acknowledge that it is not intended to be relied upon in situations where precise location information is required, or where erroneous, inaccurate or incomplete data may lead to death, personal injury, property or environmental damage. Isupportcar does not guarantee the availability, accuracy, completeness, reliability, or timeliness of location data displayed.
      12. We do not authorize anyone to make a warranty on Our behalf and You may not rely on any statement of warranty as a warranty by Us.
      13. Isupportcar and its representatives, officers, employees, agents and contractors shall not be liable for any loss, damage, claim, expense, cost (including legal costs) or liability arising directly or indirectly from Your use or non-use of the Service or the Application, or Your reliance upon the Service or the information contained upon the Application (whether arising from Isupportcar or any other person's negligence or otherwise).
      14.       15. Registration and Account
        You understand and acknowledge that You can register on the Application/website only and through a valid Email ID. For clarity, the aforesaid requirement applies to members of Deemed Communities only to the extent of a valid email ID and does not apply to members of Open Communities.
        You will be required to enter Your Email ID on the website/Application following which a verification link would be sent to Your Email ID. Upon receipt of the verification link on Your Email ID, You shall be required to click on the said link .
        Upon completion of the verification process , You will be added to a Community or Deemed Community through which You can avail the Services offered on the website/Application.
        In order to use the website/Application, You are required to provide Registration Data to Isupportcar on the website/Application. You shall not impersonate someone else or provide account information, an email address or any other information that is not Your own. We shall bear no liability for false, incomplete, old or incorrect Registration Data provided by You.
        In the event of any change in the said Registration Data, You agree to promptly update Your Registration Data on the Account so as to ensure that the communication We intend to send to You is promptly delivered to You and is not sent to any other entity/third party.
        Isupportcar will store the Registration Data provided by You for contacting You for all Service related matters. You may promptly inform Us on any change in the Registration Data provided.
        We may send any Information to You to the mobile number or Original ID registered with Us as Registration Data.
        We reserve the right to suspend or terminate Your Account with immediate effect and for an indefinite period, if We have a reason to believe that the Registration Data or any other data provided by You is incorrect or false, or that the security of Your Account has been compromised in any way, or any other reason We may find it to just. We also reserve the right to suspend Your Account with immediate effect and for an indefinite period upon receipt of any complaint from Your Co Passenger and/or the CSP.
        It is Your responsibility to check to ensure You download the correct application for Your device. We are not liable if You do not have a compatible mobile device or if You download the wrong version of the Application for Your mobile device. We reserve the right to terminate the Service and the use of the Application should You be using the Service or Application with an incompatible or unauthorized device.
        We allow You to open only one Account in respect of one Email ID.
        You will not assign or otherwise transfer Your Account to any third party.
        In case of any unauthorized use of Your Account, You are to bring the same to Our notice promptly. In the event of the such unauthorized use, please immediately reach Us at [email protected]
        In case, You are unable to access Your Account, please inform Us at [email protected] and make a written request for blocking Your Account. We will not be liable for any unauthorized transactions made through Your Account.

You have to contact to your nearest regional office or you can directly call to the main branch for new registration of your car.
you have to submit your required documents to the company.
The Isupportcar company or staffs will see your car condition in your nearest regional office.
